Intended Audience includes Special Education Supervisors, Facilitators and Teachers
When parents agree to a waiver, they are waiving an in-person IEP meeting. It is not necessary to get all the IEP team members' signatures, because a formal meeting didn't happen. Parents, case managers, and special education building level supervisor’s signatures need to be included on the waiver form.
When a Waiver CAN be Used
Potential uses for the waiver letter include:
- Schedule change since annual IEP developed (such as, moving a co-taught or SE class to another semester or year)
- Adding or deleting accommodations
- Changing from General Education (GEN-ED) without services to co-taught class (or vice versa)
- Adjusting a particular goal based on data
- Updating a Present Level of Education Performance (PLEP)
When a Waiver CANNOT be Used
- For annual IEP development
- To discuss diploma track options
- To make a change affecting Least Restrictive Environment (LRE)
Steps for Using a Waiver:
- Contact your school’s Special Education Facilitator or Specialist
- Call the parent
- Explain the Waiver and the purpose
- If parents are in agreement to use the waiver and the proposed changes:
- Complete the section with the change you agreed upon and sign the document.
- Obtain parent signature on the document.
- Obtain the building level special education supervisor’s signature on the document.
- Once you have the parent’s signature:
- Create an addendum in TNPulse with the agreed upon changes.
- Create a PWN for the changes made to the IEP
- Print the addendum and attach the waiver (the only signature you need is yours and the parent's signature on the waiver document. No one needs to sign the addendum.)
- Place the addendum with the waiver in the CCR
- Upload the addendum with the waiver into Pulse
- If parents are in disagreement with using the waiver and the proposed changes, offer to hold a meeting to discuss the proposed changes.
